1. ELIGIBILITY: This promotion (“Promotion”) is open to travel agencies and agents who are 18 years or older (“Travel Partner” or “entrant”). Employees of Oceania Cruises S. de R.L. (“Sponsor”) and their parents, affiliates, subsidiaries, advertising or promotional agencies together with their immediate families (spouses, parents, siblings, and children) and persons living in the same households as any of those employees are not eligible to participate in this Promotion. This Promotion is subject to all US federal, state, and local laws and regulations. This Promotion is void where prohibited or restricted by law.
2. ENTRY: This Promotion provides Travel Partners the chance to win the prize noted below. Travel Partners will receive one entry into the prize drawing after they have fully completed and submitted the survey questions no later than Monday, March 13th. Any individual who attempts to enter multiple times will be disqualified from participation in this Promotion. Sponsor is not responsible for lost, late, illegible, corrupted, or misdirected entries.
The odds of winning depend on the number of eligible entries received.
3. PRIZE & APPROXIMATE RETAIL VALUE (ARV): One winner will be randomly selected from among all eligible entries received. The potential winner will receive an email with available sailings. Prize is a cruise for two people, the Travel Partner and one guest, based on double occupancy in Veranda Categories. Cruise length is up to 14 days. Offer is subject to availability as determined by Sponsor. Third and fourth guest in the stateroom is based on availability and subject to the prevailing rate(s) at time of confirmation. Offer is cruise only and does not include airfare, transfers, pre/post land packages, shore excursions, gratuities, or any government fees or taxes. Approximate retail value of prize: $10,000. The actual value will vary depending upon points of departure and fare fluctuations. If the actual value turns out to be less than the stated ARV, the difference will not be awarded in cash. Winner must travel on dates specified by Sponsor, or may forfeit prize. If the voyage is postponed or cancelled for any reason after travel is arranged, balance of trip will be awarded in full satisfaction of prize, and no additional prize will be awarded. Selected airline and hotel are at the sole discretion of the Sponsor. Certain restrictions and blackout dates apply and exact travel dates and arrangements subject to availability.
Winning the prize is contingent upon fulfilling all requirements set forth herein. PLEASE NOTE: All taxes on prize are the sole responsibility of the winner. Where not prohibited, affidavit of eligibility (including SSN), prize acceptance form, tax information, assignment of rights, publicity release, and/or mutually acceptable liability releases may be required from winner and, if applicable, guest. Prize is non-transferable, and no substitution or cash equivalent is allowed except in Sponsor’s sole discretion. Prize consists only of items specifically listed as part of the prize.
Offer is subject to availability as determined by Sponsor and must be booked at least 90 days prior to the sailing date. Offer is non-commissionable and non-transferable. 4. SELECTION OF THE WINNER / WINNER CONFIRMATION: Prize winner will be chosen by a random drawing from among all eligible entries received. Drawing will be conducted in accordance with the Official Rules by the Sponsor, whose decisions on all matters related to the Promotion are binding and final. Potential winners will be notified at the email address provided on the entry, and potential winner will be required to respond within five calendar days of the initial notification by email, or the prize will be forfeited and an alternate winner will be chosen. If Sponsor is unable to contact the potential winner, or if potential winner fails to respond within five days of Sponsor’s notification, Sponsor may select an alternate winner. Affidavit of eligibility, prize acceptance form, tax information, publicity release, and/or mutually acceptable liability releases may be required from winner and guest, and, if so, must be returned within the specified time or prize will be forfeited and alternate winner chosen.
5. PUBLICITY RELEASE: Except where prohibited, acceptance of a prize constitutes winner’s consent that his or her name, likeness, voice and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.
6. ENTRANTS’ AGREEMENT TO ABIDE BY RULES: By entering, entrant agrees he/she has read, accepted and will abide by these Official Rules and agrees that any dispute with regard to the conduct of this Promotion, rule interpretation and application, the awarding of the prize, or any other matter related to the Promotion, shall be submitted to Sponsor, whose decision shall be binding and final.
7. RELEASE OF LIABILITY: By participating, entrant agrees to release and hold harmless Sponsor, and its parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations (the “Releasees”) from any injury, loss or damage to person, including death, or property due in-whole or in-part, directly or indirectly, to the acceptance or use/misuse of the prize, participation in any Promotion-related activity, or participation in the Promotion.
8. LIMITATION OF LIABILITY: The Releasees will not be responsible for any typographical or other error in the printing of this offer, the administration of the Promotion, the selection of entrants, in the announcement of the prize, including erroneous appearance of qualification for the prize, any entries or entrants disqualified for any of the reasons stated in these Official Rules, or any loss, damage or claims caused by, or in any way related to the prize or the Promotion itself. Releasees are not responsible for any injury or damage to any person’s computer or related equipment resulting from or relating to participation in this Promotion or downloading any material related to this Promotion. Releases assume no responsibility for Promotion’s website, computer system, hardware, software or program malfunctions or other errors, failures, delayed computer transactions or network connections, whether human, technical or otherwise in nature.
This Promotion shall be construed and evaluated only according to United States law. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY COMPUTERIZED SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGE FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. In the event of a dispute, the selected entrant may be required to provide proof that he or she is the authorized holder of the identified e-mail account.
Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend this Promotion, without prior individual notice, should any factor interfere with the administration, security, or proper play of this Sweepstakes as contemplated by these Official Rules. If for any reason Sponsor is prevented from continuing with this Promotion, Sponsor shall have the right, in its sole discretion, but not the obligation, to award the prize from among all eligible entries received to date. All entries are the property of Sponsor and are not returnable.
9. DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the PROMOTION, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Florida. Jurisdiction and venue shall be solely within the courts of Miami-Dade County, Florida AND THE SUPERIOR COURT OF ONTARIO, AS APPLICABLE. Except where prohibited, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any Prize awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this PROMOTION, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
